Legal Standards
If you search google for legal standards you will find numerous legal standards for just about everything. There is legal standards for the protection of a person, agriculture, computer forensic, postnuptial agreements, workforce, wildlife and many more. We will focus on some of these topics and their legal standards.
I have found a document regarding "International Legal Standards for the protection of person deprived of their Liberty". The legal standards includes the prohibition of torture and cruel, inhuman, or degrading treatment or punishment. The right to life and prohibition of torture and other inhuman treatments or punishments are also found in all major general human rights treaties which are also the norm in International Humanitarian law. There is also legal requirements as to the places of dentention and registrations of detainees and prisoners which you can read more in detail in the link provided. [source: www.ohchr.org].
In Victoria Australia, there are legal standards in agriculture in terms of animal welfare. Animal Welfare is the Ensurance that the welfare of animals used in rodeos is the main objective of the legislation governing the running of rodeos in Victoria. The licensing and operation of rodeos in Victoria is regulated under the Prevention of Cruelty to Animals Act and Regulations. This legislation sets out requirements for both operators and participants in rodeos/rodeo schools. The legislation separates the responsibilities into three areas, those requirements which are solely the responsibility of the licence/permit holder, those which are the responsibility of the attending veterinary practitioner and those for which anyone not complying may be held responsible. Computer forensic is a very interesting one but are more and more common in this techology age. I have found an example of a practical application of computer forensics; Company X suspects that one of its employees is viewing child ponography on a compnay computer, the company could request that investigators sieze and analyse this computer for evidence of this alleged crime. The investigator then have a big task ahead of him/her and must follow certain procedures to ensure that the evidence is solid and will hold up in court. [source: www.sans.org].
For postnuptial agreements I have found an interesting article on it written by Irene Olszewski based on the Connecticut Supreme Court. It has mentioned that Postnuptial agreements are as common among gay and lesbian couples as they are among straight couples. The court defined what is fair and equitable postnuptial agreement; "if the agreement is made voluntarily, and without any undue influence, fraud, coercion, duress or similar defect. Moreover, each spouse must be given full, fair and reasonable disclosure of the amount, character and value of property, both jointly and separately held, and all of the financial obligations and income of the other spouse. This mandatory disclosure requirement is a result of the deeply personal marital relationship." [source: ctlgbtlaw.wordpress.com].
I have found a good Australian website regarding legal standards on bullying at work. It states that, Under Section 21, employers have a duty under the Victorian Occupational Health and Safety Act (2004) to provide and maintain for employees, as far as practicable, a working environment that is safe and without risks to health. Health was defined as including psychological health which means that the employer must address workplace hazards such as bullying, stress and fatigue. WorkSafe Victoria issued a guide in 2009, Preventing and addressing bullying at work. Go to Worksafe Victoria to read more on bullying and occupational violence. [source: www.ohsrep.org.au].
